Admissions Advsory Agreement Terms

TERMS AND CONDITIONS

The undersigned Client engages ClarityEd to provide various school/university admissions advisory services to Client on the following terms and conditions:

References in this agreement to “Client” or “Student” shall include student, student’s parent, student’s legal guardian, student’s school or party paying. References to “ClarityEd” shall include the company, and all its faculty, employees, partners and affiliated companies, if any.

1. Engagement of ClarityEd. Client appoints and engages ClarityEd with respect to the services and for the fees specified in Section 2 and agrees to pay ClarityEd as set forth in Section 3. ClarityEd accepts the appointment and engagement with respect to the services specified in Section 2. The words school, college or university are used in synonymous here.

2. Services and Compensation. Client purchases the school/university admissions advisory/counseling and/or general educational counseling provided by ClarityEd as outlined in the Program Description or email. The Client will be billed for the work provided at the rate outlined in the Program Fees or email.

3. Payment Policy. All fees are the responsibility of Client and must be paid in full before commencement of services unless otherwise indicated in the Program Agreement(s). ClarityEd accepts payment by money wire, by personal checks made out to ClarityEd or by a United States-based credit card drawn on a United States bank. However, Clients who submit checks that are returned for insufficient funds will be charged an additional fee of $100. Client agrees to pay ClarityEd an additional 10% of the total amount outstanding if payment is late by 7 days or more. There are no refunds for admissions advisory services, including any unused admissions advisory hours. Unused admissions advisory hours or hours may not be transferred to another student. All fees are subject to change. PayPal, debit card and credit card methods of payment incur 5% additional processing fee.

4. Cancellation Policy. If Client wishes to change or cancel an appointment, notice must be given to ClarityEd at least 72 hours in advance of said appointment. In the event that such notice is not given, ClarityEd session time will be deducted from Client’s admissions advisory program for said appointment.

5. Copies of Materials. Student agrees to provide log-in information for The Common Application and any other school application websites to which Client applies. Student also agrees to provide log-in information for The College Board and/or ACT websites upon enrollment in an ClarityEd program. All material generated by or received by ClarityEd regarding Client, including the editing of any documents, the results of practice tests and The College Board and/or ACT, Inc. administered tests, as well as any correspondence with the Client, will be retained. Client agrees to submit all final application documents to ClarityEd for all schools to which Client applies. This includes, but is not limited to final essays, resumes, test scores and transcripts. On the express condition that prior consent is obtained and that all information in a Client’s school/university application or any parts thereof, including any school/university essays that would in any way reveals Client’s identity are removed, Client agrees to provide his/her consent to ClarityEd and their respective affiliates, and grants the right to use, reproduce, or prepare derivative works to be included in future materials or books that are produced, published or distributed by such entities and affiliates, based upon the client’s school/university applications or any parts thereof, including any school/university essays.

6. Responsibilities of the Client. It is the sole responsibility of the Client to remain in close communication with ClarityEd regarding any university admission correspondence from colleges and other pertinent information to the university admissions process. This includes, but not limited to, the following: (I) Maintaining communication with the high school advisor and following the requirements of the high school admissions advisory office. This includes communication from high school personnel regarding the school’s university application procedures and internal deadlines for requesting transcripts, letters of recommendation and other documents received from the high school. (ii) Confirming all application deadlines and required application materials including, but not limited to, standardized test requirements, essays, applications, letters of recommendation and application fees. (iii) Ensuring that all written portions of the university applications are the student’s own work. (iv) Monitoring status of applications and responding to all offers of enrollment.

7. Scheduling & Travel Policy. This Agreement is based on the understanding that all of ClarityEd’s admissions advisory services will be provided by Internet voice/video, telephone, fax or email, or in-person at the ClarityEd office listed below. However, in the event that any such services are provided in a meeting between a minor Client and the ClarityEd advisor/tutor at the Client’s home, then a guardian must be present for the entirety of the admissions advisory session. In-person sessions may also be held in a public place such as a library. For in-person advisory sessions that occur in any location other than the ClarityEd office listed below or the advisor’s home city, then the following applies:

  • The Client agrees to pay ClarityEd for all advisor/tutor travel costs to the session location, the advisor/tutor’s “Travel Rate” or “Travel Day Rate” as applicable for all travel time, and the costs of ClarityEd services rendered upon arrival.

  • Travel time is considered to begin when the advisor/tutor leaves his or her home for the session and end upon arrival at the session location. The travel time for the return trip will be computed on the same basis.

  • If the session is at a location less than 75 miles from the advisor/tutor’s home, then the advisor/tutor’s “Travel Rate” for travel time will be equal to his or her hourly rate for admissions advisory services.
  • If the session is at a location more than 75 miles from the advisor/tutor’s home, then the advisor/tutor’s “Travel Day Rate” will be equal to four hours of the advisor/tutor’s “Travel Rate” as provided above. In such event, the Client agrees to pay the advisor/tutor’s “Travel Day Rate” for each day of travel required, in addition to arranging and paying for all airfare, transportation, and room and board. The Client agrees that the advisor/tutor will travel by air and that any flight four or more hours in length will be booked in business class, unless otherwise agreed upon by the Client and the advisor/tutor. In addition, the Client agrees to pay the advisor/tutor’s “Day Rate” for each day the advisor/tutor is providing Client services at such session location. The advisor/tutor’s “Day Rate” will be equal to four hours of the advisor/tutor’s hourly rate for advisor services, provided, however, that if more than four hours of such services are provided in a day, then such “Day Rate” will be based on the actual session time incurred.

8. Confidentiality. Client acknowledges that advisor and relevant staff may have access to confidential information through client’s work with ClarityEd and the Common Application website. Except as otherwise set forth herein, ClarityEd agrees to keep private and confidential all application materials submitted to it by, or that it receives from Client.

9. Continuation of Programs. ClarityEd will notify Client as Admissions Advisory Program nears completion to provide options for enrollment in a continuing a program, as needed. Ongoing sessions scheduled beyond Program parameters may be suspended without authorized payment. In the unlikely event that admissions advisory program hours in excess of the Program have taken place between notification of Program nearing completion and re-enrollment, Client authorizes ClarityEd to charge credit card on file for said unpaid session(s) or admissions advisory hour(s) at the rate stated in program or agrees to pay later after receiving invoice.

10. Non-Solicitation of ClarityEd’s Employees and our Faculty Affiliates. Client agrees not to solicit for employment, hire, or engage as an independent contractor, or permit any organization directly or indirectly controlled by Client to solicit for employment, hire, or engage as an independent contractor, any person employed by ClarityEd and our faculty affiliates at any time during the term and up to one year after ClarityEd’s provision of services to Client.

11. Truthful Applications and Standardized Testing. Client represents, warrants and covenants to ClarityEd that Student has filled out, and shall fill out, any school/university applications and related documentation truthfully to the best of Student’s knowledge and, in the event Student has taken or shall take the SAT, ACT, AP Exams or any other standardized tests (“Standardized Tests”), that Student has honestly followed, and shall continue to follow, all appropriate procedures with respect to Standardized Tests. Client acknowledges and agrees that completing such materials and tests truthfully and honestly is a critical part of the admissions process and that ClarityEd may terminate this Agreement without refund in the event of any breach by Client of this provision Client further represents, warrants and covenants to ClarityEd that Client has informed, and shall inform, ClarityEd without delay, of any disciplinary, judicial or criminal action taken against Student either in or outside of school, including (but not limited to) suspensions, expulsion, and arrests. ClarityEd operates on the philosophy that advisors work best with Students one-on-one. While we encourage both parents to be present during the initial Consultation (if possible), all subsequent meetings are conducted between advisor and Student only, either by phone, internet voice/video or in person. in order to enhance the services which ClarityEd provides hereunder, Client acknowledges and agrees that ClarityEd may record sessions between its advisor and Students and, in such connection, ClarityEd agrees to maintain the confidentiality of all such recordings. if a parent would like an individual in-person or phone session with a advisor, such a meeting can be arranged and billed at the hourly rate.

12. Admission and Attendance Notifications. Client will notify ClarityEd of any and all university decisions as well as Client’s matriculations decision.

13. Miscellaneous. This Agreement may be executed by email, online form or physical paper and in any number of identical counterparts, any of which may contain the signatures of fewer than all the parties, and together shall constitute a single agreement. This Agreement constitutes the entire understanding between Client and ClarityEd with respect to the matters referred to herein. This Agreement may only be amended by a written agreement signed by client and ClarityEd. This Agreement shall be governed by and construed under the laws of the State of Connecticut without regard to its conflicts of law rules.

14. DISCLAIMER. ClarityEd does not fill Student’s college applications or scholarship applications. ClarityEd does not and cannot write Student’s school/university essays. However, ClarityEd does assist its Clients in developing school/university essays by making detailed suggestions for content, structure, tone and diction and by reviewing and commenting on subsequent revisions until the Client feels they are the best they can be. Clarityed does not guarantee admission into any school, university, university or similiar program. The admissions process is often arbitrary and accordingly it is expressly agreed that ClarityEd is not liable for any decision made by an admissions committee. ClarityEd is not affiliated with or approved by the Ivy League, university, school, university, or similar program.

The Student certifies that all the information provided is complete and correct. The Student certifies that he/she is not an employee, owner or representative of any other admissions advisory company, and that he/she is registering in ClarityEd’s program solely for the purpose stated here.

I have read and understand the above ClarityEd Admissions Advisory Agreement and agree to abide by the policies and procedures stated herein.

PROGRAM DESCRIPTION

This program will begin upon enrollment and see Student through application season in his senior year. Admissions advisory services in the program may include the following services:

  • Collection and review of educational and personal histories, school records and standardized testing records

  • Analysis of student’s interests, strengths, skills and academic and extracurricular goals

  • Family conference regarding university preference

  • Extensive search of schools and programs and list of potential schools

  • Evaluation of student’s merit aid, scholarship, and university aid eligibility

  • Advice on securing letters of recommendation (the who, when and how)

  • Development of “to do” list for educational testing, university visits, application completion and submission

  • University visit advice and preparation

  • Review of appropriate timelines and university planning checklists

  • University essay brainstorming and editing

  • Critique of completed applications

  • Support with final enrollment decision

Student will complete around 10-12 full college applications, depending on the nature of the applications, with ClarityEd, by the end of the admissions advisory program.

Freshman year is the perfect time to begin working with ClarityEd! When reviewing applicants, colleges consider all four years of high school grades, courses, activities, summer plans, and awards, so it’s important to start the college preparation process as early as possible. Starting a program freshman year gives Student ample time to work with Advisor to identify interests, plan challenging course loads, select appropriate and impactful extracurricular activities, as well as apply to summer experiences. While meetings with Advisor will be less frequent in the first two years of the program, guidance during this time is crucial as this is the foundation of Student’s profile as a college applicant.

During junior year, meetings with Advisor will become more frequent as they work to finalize Student’s balanced college list, execute the testing schedule as it will relate to admissions requirements, and begin to brainstorm a compelling personal statement. In the summer following junior year, Student will work with Advisor to draft, edit and finalize his full college applications including all supplemental essays. Generally, we aim to have many of the applications near completion by the time Student returns back to school for his senior year.

Please note that all ClarityEd programs are based on a number of hours, and that any mention of “hours” refers only to billable hours. Billable hours are deducted for the duration of each admissions advisory session between Advisor and Student. Billable hours also include any time Advisor spends independently editing essays, supplemental questions, and application information.
